The introduction of the Electronic Communications Code in December 2017 radically changed the telecommunication market with huge impacts on new sites, but also potentially existing sites. The purpose of the Electronic Communications Code is to regulate the relationship between the landowner and telecoms operators from installation through to ongoing maintenance.
However, the legislation has brought about changes which are predominantly to the advantage of site operators, causing delays in reaching agreements for new sites. The legislation contains an entirely different system for agreeing “rents'', which is complex and requires expert knowledge of recent deals and transactions to secure a fair return.
