The new Electronic Communications Code (ECC), under the Digital Economy Act, was implemented in December 2017. There was much speculation over the impact of this new legislation but the picture remains far from clear.
The new code was intended to favour the operator to assist with improving capacity and coverage, particularly in rural areas, where operators have historically claimed that new development on historic commercial terms would be uneconomic. The increasing demands on the existing infrastructure and future role of 5G continue to show the inadequacies of cover and service in many areas.
The code applies to new leases and renewals and we are continuing to monitor its implementation. We have recently agreed some new leases and renewals which are currently being documented following the conclusion of successful negotiations. Most agreements now include a confidentiality clause!
It is still surprising to hear that a large proportion of property owners do not seek professional advice when considering potential lease terms.
